D3 Privacy Notice

1. INTRODUCTION

Thank you for choosing to be part of the D3 community. We are committed to protecting your privacy. This Privacy Notice explains how we collect, use, and disclose information through our websites — www.d3.com, www.d3.inc and www.d3.app — and all related sites, software, and services that link to or reference this Privacy Notice (collectively, the “Platform”). The Platform is owned and operated by D3 Global, Inc. (“D3,” “we,” “us,” or “our”).

This Policy applies to information collected through the Platform, as well as to certain related interactions you may have with us. Additional details, including how we work with third parties, are described in later sections of this Privacy Notice.

This Privacy Policy describes, among other things:

  • Personal and other information we collect about you;
  • How we use your information;
  • How we may share your information with third parties; and
  • Your choices regarding the personal information we collect about you.

To the extent you are acting on behalf of an entity accessing the Platform, you agree to obtain all necessary consents from the relevant individuals to enable us to collect, use, hold and process that information in accordance with this Privacy Notice, including to provide such individual with a copy of this Privacy Notice.

2. COLLECTION OF YOUR PERSONAL AND OTHER INFORMATION

When you access or use the Platform, we may collect the following types of information:

A. Personal Information:

This includes information that identifies you or can be used to identify you, such as:

  • Email address
  • Blockchain addresses
  • IP address
  • Discord username
  • Credit card details
  • Proof of identity or KYC information, which may include your name, physical address, and related documents (only where legally required to deliver products or services)
  • Any other information you choose to provide to us

B. Third-Party Platform Data:

If you decide to connect your account to a third-party platform like Discord, we may collect and share certain information from that platform, such as your name, email, demographic details, or content you’ve made public there. We are not responsible for how third parties handle your data; their privacy policies will apply.

C. Non-Personal Information:

We also collect certain information that does not directly identify you. This may include:

  • Device and browser details (e.g., make, model, OS, HTTP headers)
  • Pages viewed and content interacted with on the Platform
  • General location (city, state, country)
  • Usage trends and clickstream data

This information is collected automatically through cookies, browser storage, log files, and similar technologies (see our “Cookies and Tracking Technologies” section for more details). We do not use non-personal information to try to identify you. However, if we later link it to personal information, we will treat it as such.

Information collected by the Platform may be collected by us or one of our service providers, but in either case, this Privacy Notice will govern the collection, use, and sharing of the information.

3. USE OF YOUR INFORMATION AND LEGAL BASIS FOR PROCESSING

We use the information we collect, including Personal Information as defined by applicable privacy laws - such as the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), for the following lawful purposes:

  • To perform our contractual obligations, including processing transactions you authorize and providing the products or services you request
  • To fulfill our legitimate interests, such as operating, maintaining, and improving the Platform; conducting internal research and development; and securing our systems
  • To comply with legal obligations, including regulatory requirements, law enforcement requests, and dispute resolution
  • To protect vital interests, such as detecting, investigating, or preventing security incidents, fraud, or other harmful, unauthorized, or illegal activity
  • To communicate with you, including account notices, security updates, and — where permitted — marketing communications
  • To personalize your experience, including tailoring content, offers, and recommendations based on your preferences
  • To provide customer support and manage your account
  • With your consent, where required by law, including for the use of certain cookies, marketing communications, or optional integrations with third-party platforms

Where we rely on your consent as the legal basis for processing, you have the right to withdraw that consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

Information collected through the Platform may be transferred to, processed, and stored in the United States or other countries where we or our service providers operate. These jurisdictions may not offer the same level of data protection as your home country. Where required by applicable law, we implement appropriate safeguards (such as Standard Contractual Clauses) to protect your personal information during cross-border transfers.

4. DISCLOSURE OF YOUR INFORMATION

We may disclose your Personal Information to third parties as outlined below, in accordance with applicable data protection laws, including the GDPR and CCPA:

A. Service Providers and Platform Functionality

We may share your Personal Information and non-Personal Information with trusted third-party service providers that assist us in operating the Platform and delivering services. These providers perform tasks such as data storage, hosting, audits, analytics, and support. Examples include:

  • Google Analytics
  • AWS
  • Discord
  • Twitter
  • Instagram

These third parties are only permitted to use your data for the purpose of providing services on our behalf and are subject to contractual obligations, including data protection and confidentiality requirements.

B. Third-Party Integrations

When you choose to connect your D3 account with third-party services (such as Discord), we may share and receive information necessary to enable those integrations. Your interactions with those third-party platforms are governed by their own privacy policies.

C. Legal and Regulatory Requirements

We may disclose your Personal Information where necessary to:

  • Comply with applicable laws, regulations, legal processes, or enforceable governmental requests;
  • Enforce or investigate potential violations of our terms and policies;
  • Protect the rights, safety, or property of D3, our users, or others;
  • Detect, prevent, or otherwise address fraud, security breaches, or technical issues; or
  • Prevent or respond to unlawful activity or threats to national security.

D. Business Transfers

In connection with a potential or actual corporate transaction (such as a merger, acquisition, reorganization, or sale of assets), your information may be disclosed or transferred as part of that transaction. We will use reasonable efforts to notify you of any material change in ownership or control that affects your Personal Information.

E. With Your Consent

We may disclose your Personal Information to other third parties where you have given us express consent to do so.

F. Aggregated or Non-Identifiable Information

We may share non-Personal Information, including aggregated data that does not identify you individually, with business partners, investors, or other third parties for research, reporting, or other legitimate business purposes.

5. COOKIES AND OTHER TRACKING TECHNOLOGIES

When you access or use the Platform, we may collect non-Personal Information automatically to better understand your interactions and improve our services. This includes information about how, when, and which features you use, and any third-party platforms you connect. We may also collect technical data such as your device’s unique identifier (e.g., UDID or MAC address). To support this, we use a variety of standard technologies, including cookies, local browser storage, and web beacons (for convenience, collectively referred to as “cookies”).

We use the following types of cookies:

  • Strictly Necessary Cookies. These cookies are essential for the operation of the Platform. They enable core functions such as page navigation and secure access to areas of the site (e.g., maintaining session login).
  • Performance and Analytics Cookies. These help us understand how users interact with the Platform, including visitor counts, navigation paths, and usage patterns. We may use tools such as Google Analytics for this purpose. This helps us optimize user experience and identify areas for improvement.
  • Functionality Cookies. These allow the Platform to remember choices you make (e.g., language or region) and provide enhanced, personalized features.
  • Targeting or Advertising Cookies. These cookies may record your visit, pages viewed, and links followed. This data helps tailor advertising and messaging to your interests and may be shared with third-party service providers that assist us with ad delivery or retargeting.
  • Third-Party Cookies. Some features or content on the Platform may be provided by third parties (e.g., social media plugins or embedded content). These third parties may place cookies on your device. We do not control the use of such cookies and encourage you to review the privacy and cookie policies of those third parties.

You may control or disable cookies through your browser settings or using in-platform cookie consent tools where available. Please note that disabling certain cookies may affect the functionality or availability of parts of the Platform.

Where required by applicable law (e.g., GDPR or ePrivacy Directive), we will obtain your consent before placing non-essential cookies on your device.

6. YOUR RIGHTS AND CHOICES ABOUT YOUR DATA

If you would like to access, update, correct, or delete the personal information we have collected about you—or if you wish to deactivate or delete your D3 account—please email us at [email protected].

We will make reasonable efforts to locate and provide you with access to your Personal Information, and to correct or delete it at your request, unless we are required or permitted to retain it for legal or legitimate business purposes. We may also retain cached or archived copies of information as permitted by law.

Please note: We cannot edit or delete information that is stored on a public blockchain, such as the Ethereum blockchain, since we do not have custody or control over blockchain networks. This may include records of purchases, sales, or transfers associated with your blockchain address and digital assets.

To help us fulfill your request, we may ask you to verify your identity and confirm the specific data you are referencing. We may decline requests in certain cases—for example, if a request is repetitive, overly burdensome, affects the privacy of others, or cannot be fulfilled due to technical limitations or backup constraints. Where we are able to provide access or correction, we generally do so free of charge, unless it would require disproportionate effort.

Please note that deleting your Personal Information may limit your ability to use certain features of the Platform. Even after your request, we may need to retain certain information to satisfy legal, accounting, or dispute resolution obligations.

To opt out of marketing emails, click the “unsubscribe” link in any marketing message. Please allow up to ten (10) business days for your opt-out request to take effect. Note that you may still receive important account-related emails (e.g., transactional or security notices).

If you are a resident of the European Union, United Kingdom, or California, additional rights may apply under the GDPR, UK GDPR, or CCPA. Please see our “GDPR Notice” and “Notice to California Residents” below for more information.

7. CHILDREN AND MINORS

The Platform is not intended for use by children under the age of 13, and we do not knowingly collect Personal Information from anyone under 13. If you are under 13, do not use the Platform or provide any information to us.

By using the Platform, you confirm that you are at least 13 years old. If we become aware that we have collected Personal Information from a child under 13 without verified parental consent, we will delete that information. 8. INFORMATION SECURITY

We implement reasonable technical and organizational safeguards to help protect your Personal Information against loss, misuse, and unauthorized access or disclosure. However, no data transmission or storage system is guaranteed to be 100% secure. Accordingly, we cannot guarantee the security of your information.

We restrict access to Personal Information to those D3 employees, contractors, and service providers who need to know that information to operate, develop, or support the Platform. Any third parties with whom we share Personal Information are required to use reasonable safeguards and use the data only for the purpose for which it was shared.

9. CALIFORNIA PRIVACY RIGHTS

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), grants you the right to:

  • Know the categories and specific pieces of Personal Information we collect, the purposes for collection, and the categories of third parties with whom we share it.
  • Request access to or deletion of your Personal Information.
  • Opt out of the sale or sharing of Personal Information (though we do not sell your Personal Information).
  • Correct inaccurate Personal Information.
  • Limit use and disclosure of sensitive Personal Information (to the extent we collect any).

You may submit these requests by contacting us at [email protected]. We will not discriminate against you for exercising any of your CCPA rights. We may take steps to verify your identity before fulfilling certain requests.

Additionally, California Civil Code § 1798.83 allows California users to request information regarding the disclosure of Personal Information to third parties for their direct marketing purposes. We do not disclose Personal Information for such purposes without your consent.

10. GDPR NOTICE

If you are located in the European Economic Area, the United Kingdom, or Switzerland, the General Data Protection Regulation (“GDPR”) and the UK GDPR provide you with additional rights regarding your Personal Information. Your GDPR Rights include the right to:

  • Access your Personal Information;
  • Correct inaccuracies in your Personal Information;
  • Delete your Personal Information under certain conditions;
  • Restrict our processing of your Personal Information;
  • Port your Personal Information to another service provider;
  • Object to certain processing activities, including direct marketing.

You may withdraw your consent at any time; however, this will not affect the legality of processing based on consent before its withdrawal.

Please note that the Platform may link or integrate with third-party sites, services or apps. We are not responsible for the privacy or security policies or practices or the content of such third parties. Accordingly, we encourage you to review the privacy and security policies and terms of service of those third parties so that you understand how those websites collect, use, share and protect your information.

12. CHANGES TO THIS POLICY

We may modify or update this Privacy Notice periodically with or without prior notice by posting the updated policy on this page. You can always check the “Last Updated” date at the top of this document to see when the Privacy Notice was last changed. If we make any material changes to this Privacy Notice, we will notify you by reasonable means, which may include by e-mail or posting a notice of the changes on our website prior to the changes becoming effective. We encourage you to check this Privacy Notice from time to time.
